Terms and Conditions

This page states the terms and conditions under which you may access and use the www.propertyguys.com site (the "Site"). Please read these provisions carefully. If you do not agree with the following provisions, you should immediately exit the Site and discontinue any use of its services. By using the Site, you are indicating your acceptance to be bound by this User Agreement. PropertyGuys.com Inc. ("PropertyGuys.com" or the "Company") reserves the right to amend this User Agreement from time to time. The terms "You", "Your" and "User" are used in this document to refer to all individuals and/or entities accessing this Site.

Disclaimer

PropertyGuys.com Inc. is a "For Sale By Owner" advertising & marketing firm. The Company is not a Real Estate broker/agent or a mortgage broker. It represents neither the buyer nor the seller and receives no commission on the sale of properties listed in this service. The Company assumes no responsibility, and makes no guarantee, implied or otherwise, as to the accuracy or validity of information contained in the property listings. All information contained in the listings has been provided by the property vendor/rentor. PropertyGuys.com does not act as a mortgage broker.

PropertyGuys.com Inc. does not warrant or make any representations or claims as to the quality, accuracy, currency or otherwise of any information contained on our Site or any sites linked to it. Any decision or action taken based on information contained in our Site or any sites linked to it are the sole responsibility of the user. The Company will not be liable for any claim or damage arising out of interpretation, reliance upon or other use of the information.

Using PropertyGuys.com

While using our Site, you will not:

• violate any laws, third party rights, or our policies;
• copy materials on our Site, reverse engineer or break into our Site, nor use the Site materials, products or services to violate any law;
• use our Site other than in accordance with our policies, as may be reflected in this User Agreement;
• disclose your password for others for use;
• use our emailConnect system for any unauthorized or commercial purpose, except those specifically permitted by us;
• use the Site if you are not able to form legally binding contracts or are under the age of 18
• post false, inaccurate, misleading, defamatory, or libelous content;
• distribute or post spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm PropertyGuys.com, or the interests or property of PropertyGuys.com users;
• copy, modify, or distribute content from the Site and PropertyGuys.com's copyrights and trademarks; or
• harvest or otherwise collect information about our customers, users, or affiliates, including email addresses, without their consent.

Affiliate Program

We want to pay you for sharing the benefits of PropertyGuys.com with your friends and family! To ensure you receive your referral incentive as part of the “Affiliate Program”, please review the “Affiliate Program” terms and conditions below:

• The referrer must be registered with PropertyGuys.com.
• The person(s) you refer must not be an existing PropertyGuys.com customer at the time the referral is submitted.
• A person is considered a referral if they register on PropertyGuys.com after having clicked the PropertyGuys.com link in the referral email. Due to tracking mechanisms in the referral email, if a person that is referred signs up through any process other than clicking on the referral email link, then the referral is not recognized as having occurred.
• In the event that more than one referral is received for the same person, then whichever referral email link the referree clicked to access and register on PropertyGuys.com will be eligible for the referral.
• The referred customer must result in a “paid” marketing package to be eligible.
• The referral incentives will be paid to the affiliate for each successful referral. A successful referral means the referred person(s) has purchased a PropertyGuys.com marketing package. The marketing package must be paid in full prior to the referral incentive being paid.
• There is no limit to the number of referrals that an “Affiliate” can submit.
• The person(s) referred must purchase a marketing package within six months from the time of the referral initiation.
• PropertyGuys.com reserves the right to withdraw or change this offer at any time without prior notice.
• PropertyGuys.com franchises are independently owned and operated and as such PropertyGuys.com Inc. is not responsible for any payment under the affiliate program.
• PropertyGuys.com reserves the right to cancel your “Affiliate Status” at anytime without cause.
• PropertyGuys.com does not encourage unsolicited email or endorse the use of “SPAM” techniques.
• Affiliates are not employees, agents or representatives of PropertyGuys.com.

Abusing PropertyGuys.com

Please report problems, offensive content, and policy violations to us. Without limiting our remedies, we may limit, suspend, or terminate our the use of our Site, prohibit access to our Site, remove hosted content, and take all required steps to keep users off our Site if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies.

Liability

You will not hold PropertyGuys.com responsible for other users' actions or inactions. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, merchantability or safety of the property advertised, the truth or accuracy of listings, the ability of sellers to sell property, or that a seller will actually complete a property transaction.

Notwithstanding the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you have paid to us or our affiliates in the 12 months prior to the action giving rise to the liability, and (b) $100.

Copyright

All information and materials displayed or otherwise accessible through this Web site are protected by copyright law, and are owned by PropertyGuys.com or the party accredited as the provider of the Content. Except as granted in the limited license set out in this User Agreement, any use of the Content, including modification, transmission, presentation, distribution, republication, or other exploitation of our Site or of the information, materials or content on our Site is prohibited without the express prior written consent of PropertyGuys.com.

Limited License

The Company authorizes you to view and download a single copy of the material on PropertyGuys.com solely for your personal, noncommercial, or educational purposes, provided that:

• you do not modify any such content; and
• you include with and display on each copy of such content the associated copyright notice and this limited licence.

Without limiting the generality of the foregoing, you may not:

• make any commercial use of such content;
• include such content in or with any product that you create or distribute; or copy such content onto your or any other web-site.

Content License

When you provide us content, including listing information, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise the copyright, publicity, and database rights that you may have in the content. (We need these rights to host and display your content.)

Trade-Marks

PropertyGuys.com and its logos are a trade-mark of PropertyGuys.com Inc. Any unauthorized use of them is strictly prohibited.

Notices

Except as explicitly stated otherwise, legal notices shall be served on PropertyGuys.com's primary business address (in the case of PropertyGuys.com) or to the email address that you may provide to PropertyGuys.com (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to any address that you may have provided to us. In such case, notice shall be deemed given three days after the date of mailing.

The Web site contains links to third-party Web sites. These links are provided solely as a convenience to you and not as an endorsement by us of the contents of such third-party Web sites. PropertyGuys.com is not responsible for the content of any third-party Web site, nor does it make any representation or warranty of any kind regarding any third-party Web site.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, affiliates and employees), harmless from any claim or demand, including legal fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
